ข้อกำหนดและเงื่อนไขการใช้บริการรับข้อมูลข่าวสารทางจดหมายอิเล็กทรอนิกส์
ผู้ขอใช้บริการตกลงใช้บริการรับข้อมูลข่าวสารทางจดหมายอิเล็กทรอนิกส์ (E-mail) ซึ่งต่อไปนี้จะเรียกว่า “บริการข้อมูลข่าวสาร” กับธนาคาร โดยตกลงผูกพันและปฏิบัติตามข้อกำหนดและเงื่อนไขการใช้บริการดังต่อไปนี้
- ธนาคารจะส่งข้อมูลและ/หรือข่าวสารให้แก่ผู้ขอใช้บริการผ่านช่องทางอีเมลไปยังที่อยู่จดหมายอิเล็กทรอนิกส์ (E-mail Address) ที่ผู้ขอใช้บริการได้ให้ไว้แก่ธนาคารในคำขอใช้บริการที่ทำผ่านเว็บไซต์ของธนาคาร หรือที่อยู่จดหมายอิเล็กทรอนิกส์อื่นใดตามที่ผู้ขอใช้บริการแจ้งเปลี่ยนแปลงให้ธนาคารทราบตามขั้นตอนและวิธีการที่ธนาคารกำหนด
- ผู้ขอใช้บริการตกลงรับทราบว่าข้อมูลและ/หรือข่าวสารที่ธนาคารได้รวบรวม สรุป วิเคราะห์ หรือจัดทำขึ้น ไม่ว่าส่วนหนึ่งส่วนใด ภายใต้บริการข้อมูลข่าวสารนี้ เป็นเพียงข้อมูลเบื้องต้นเพื่อให้ผู้ขอใช้บริการได้รับทราบข้อมูลและ/หรือข่าวสารที่ตรงต่อความสนใจของผู้ขอใช้บริการเท่านั้น และไม่ได้มีวัตถุประสงค์เพื่อให้ความเห็นหรือคำแนะนำทางการเงิน การลงทุน ทางภาษีหรือทางกฎหมายที่เฉพาะเจาะจงแต่อย่างใด รวมทั้งธนาคารไม่รับรองความถูกต้อง ความครบถ้วน และความสมบูรณ์ของข้อมูลและ/หรือข่าวสารดังกล่าว และธนาคารไม่จำต้องรับผิดชอบในความเสียหายใดๆ อันเกิดขึ้นแก่ผู้ขอใช้บริการอันเนื่องจากการใช้บริการข้อมูลข่าวสารนี้
- ผู้ขอใช้บริการตกลงใช้ข้อมูลและ/หรือข่าวสารที่ได้รับจากธนาคารเพื่อเป็นข้อมูลเท่านั้น การใช้ ดัดแปลง เปิดเผย หรือการดำเนินการอื่นใดต่อข้อมูลและ/หรือข่าวสารดังกล่าวโดยไม่ได้รับอนุญาตหรือโดยไม่ชอบด้วยกฎหมาย อาจก่อให้เกิดความรับผิดต่อธนาคารตามกฎหมาย
- ผู้ขอใช้บริการตกลงชำระค่าบริการ และ/หรือ ค่าธรรมเนียม และ/หรือ ค่าใช้จ่ายอื่น ๆ ที่เกี่ยวกับการใช้บริการข้อมูลข่าวสารให้แก่ธนาคารตามที่ธนาคารกำหนด (ถ้ามี)
- ธนาคารมีสิทธิเพิ่มหรือเปลี่ยนแปลงข้อกำหนดและเงื่อนไขการใช้บริการ รายละเอียด วิธีการ และ/หรือ ช่องทางการให้บริการหรือใช้บริการข้อมูลข่าวสาร รวมทั้งค่าบริการ ค่าธรรมเนียม และ/หรือ ค่าใช้จ่ายอื่น ๆ เกี่ยวกับการใช้บริการข้อมูลข่าวสารได้ตามที่ธนาคารเห็นสมควร โดยธนาคารจะแจ้งให้ผู้ขอใช้บริการทราบล่วงหน้าอย่างน้อย 30 วัน โดยการปิดประกาศ ณ สำนักงานหรือสาขาของธนาคาร หรือประกาศบนเว็บไซต์ของธนาคาร หรือแจ้งเป็นลายลักษณ์อักษรไปยังผู้ขอใช้บริการ หรือโดยวิธีการอื่นที่ธนาคารเห็นสมควร ยกเว้นการเพิ่มหรือแก้ไขเปลี่ยนแปลงที่ส่งผลให้ผู้ขอใช้บริการเกิดภาระหรือความเสี่ยงเพิ่มเติมตามเกณฑ์ที่ธนาคารแห่งประเทศไทยประกาศกำหนด ธนาคารต้องได้รับ
ความยินยอมจากผู้ขอใช้บริการก่อน ทั้งนี้ ผู้ขอใช้บริการตกลงผูกพันปฏิบัติตามข้อกำหนดและเงื่อนไขการใช้บริการ
ไม่ว่าที่มีอยู่แล้วในขณะนี้ หรือที่ธนาคารจะกำหนดเพิ่มเติมและ/หรือเปลี่ยนแปลงในภายหน้าทุกประการ - ธนาคารมีสิทธิระงับเป็นการชั่วคราวหรือยกเลิกการให้บริการข้อมูลข่าวสารแก่ผู้ขอใช้บริการ และ/หรือ ยกเลิกการให้บริการข้อมูลข่าวสารของธนาคารเมื่อใดก็ได้ โดยธนาคารจะแจ้งให้ผู้ขอใช้บริการทราบล่วงหน้าอย่างน้อย 30 วัน โดยการปิดประกาศ ณ สำนักงานหรือสาขาของธนาคาร หรือประกาศบนเว็บไซต์ของธนาคาร หรือแจ้งเป็นลายลักษณ์อักษรไปยังผู้ขอใช้บริการ หรือโดยวิธีการอื่นที่ธนาคารเห็นสมควร เว้นแต่มีเหตุจำเป็นอื่นใดซึ่งไม่อาจแจ้งล่วงหน้าได้ ธนาคารจะแจ้งให้ผู้ขอใช้บริการทราบเมื่อสามารถดำเนินการได้โดยเร็ว
- ธนาคารจะเริ่มให้บริการข้อมูลข่าวสารเมื่อธนาคารได้อนุมัติการขอใช้บริการข้อมูลข่าวสารแล้ว จนกว่าผู้ขอใช้บริการจะแจ้งยกเลิกการใช้บริการข้อมูลข่าวสารเป็นลายลักษณ์อักษร หรือตามช่องทางอื่นใดที่ธนาคารกำหนด โดยแจ้งให้ธนาคารทราบล่วงหน้าไม่น้อยกว่า 30 วัน
Terms and Conditions for the Use of Receiving Newsletter via E-mail Service
The Applicant agrees to use the receiving newsletter via E-mail service, hereinafter referred to as the “Newsletter Service”, with the Bank. The Applicant agrees to be bound by and comply with the terms and conditions as follows:
- The Bank will send information and/or news to the Applicant via E-mail to the E-mail address provided by the Applicant to the Bank in the application for the use of service which is executed via the Bank’s website or any other E-mail address which the Applicant notifies to the Bank of such change pursuant to the procedure and method as prescribed by the Bank.
- The Applicant agrees and acknowledges that information and/or news which the Bank has compiled, summarized, analyzed or made, whether any part under this Newsletter Service, is only basic information for the Applicant to receive information and/or news that meets the Applicant’s interest and is not for the purpose of providing specific financial, investment, tax or legal opinions or advice. In addition, the Bank does not represent the accuracy and completeness of such information and/or news and the Bank shall not be responsible for any damages incurred to the Applicant as a result of using this Newsletter Service.
- The Applicant agrees to use information and/or news received from the Bank for information only. The use, alteration, disclosure or any other acts to such information and/or news without authorization or which is illegal may cause the Applicant to be liable to the Bank in accordance with the laws.
- The Applicant agrees to pay fees and/or service charges and/or expenses in relation to the use of the Newsletter Service to the Bank at the rate as prescribed by the Bank (if any).
- The Bank shall have the right to add or amend the terms and conditions for the use of the services, details, methods and/or channels for the provision of the Newsletter Service, including fees, service charges and/or expenses in relation to the use of the Newsletter Service as the Bank deems appropriate by notifying the Applicant at least 30 days in advance by posting such announcement at the office or branch of the Bank or on any of the Bank’s websites or by giving written notice to the Applicant or by other means as the Bank deems appropriate, except for the addition or amendment which results in increasing the burden or risks to the Applicant in accordance with the Bank of Thailand’s regulations, the Bank shall obtain consent from the Applicant before such addition or amendment. The Applicant agrees to be bound by and comply with the terms and conditions whether currently existing or as to be prescribed, amended and/or changed in the future in all respects.
- The Bank shall have the right to temporarily suspend or to cancel the provision of the Newsletter Service to the Applicant and/or to cancel the provision of the Bank’s Newsletter Service at any time by notifying the Applicant at least 30 days in advance by posting such announcement at the office or branch of the Bank or on any related website or by giving written notice to the Applicant or by other means as the Bank deems appropriate, except for any necessary occurrences for which a prior notice may not be given, the Bank will notify the Applicant as soon as practicable.
- The Bank will provide the Newsletter Service upon the Bank’s approval of the use of Newsletter Service and until the Applicant notifies the Bank to cancel the use of Newsletter Service in writing or through any other channel as prescribed by the Bank at least 30 days in advance.
